Abstract:This paper takes Chicana/Xicana indigeneity as a productive and problematic site to consider the vexed conjuncture between decolonial and postcolonial approaches to critical knowledge production. I examine the intersection between Chicana and Native feminisms as a point of entry to consider how the incommensurabilities between these formations get played out within specific sites of knowledge production. I read my positionality as a Californio Rancho descendent to explore urgent questions of landedness raised by Indigenous studies scholars and consider how we might (...) productively center questions of settlement within Chicana feminism. While Chicana relationships to land are varied, I reflect on my own positionality as a “settler Xicana” in an effort to sense the political and epistemic stakes for centering decolonial approaches in conversation with postcolonial/transnational feminisms. Trois composantes régissent notre vie en société et sont de nature à faire évoluer la règle de droit ainsi que le fonctionnement de la justice : le droit, la morale et l’éthique. Existe-t-il une hiérarchie entre ces trois normes? Quelles sont les interférences entre ces constantes qui constituent les piliers tant de la démocratie, que de l’État de droit et de la justice? Dès lors, se pose la question de la légalité face à la morale et à l’éthique. Un acte (...) pourrait-il être légal et non conforme à l’éthique, à la morale? Un acte pourrait-il être regardé comme illégal alors qu’il serait conforme à l’éthique, à la morale? Au-delà de cette réflexion d’ordre philosophique et sociétale, il est légitime de s’interroger sur la vérité judiciaire, son contenu et ses éventuelles contradictions… Il est tout aussi incontournable de rappeler que la déontologie des avocats est inscrite dans un cadre règlementaire tout en puisant sa raison d’être dans l’éthique. Nous en concluons que Droit et Justice doivent prendre en considération l’exigence éthique. Il ne saurait exister le moindre affrontement entre droit et éthique dès lors que bien qu’autonomes, ces deux normes se complètent et permettent à la société d’évoluer dans un cadre harmonisé. Understanding the mechanisms and the time and spatial evolution of penumbra following an ischemic stroke is crucially important for developing therapeutics aimed at preventing this area from evolving towards infarction. To help in integrating the available data, we decided to build a formal model. We first collected and categorised the major available evidence from animal models and human observations and summarized this knowledge in a flow-chart with the potential key components of an evolving stroke. Components were grouped in ten sub-models (...) that could be modelled and tested independently: the sub-models of tissue reactions, ionic movements, oedema development, glutamate excitotoxicity, spreading depression, NO synthesis, inflammation, necrosis, apoptosis, and reperfusion. Then, we figured out markers, identified mediators and chose the level of complexity to model these sub-models. We first applied this integrative approach to build a model based on cytotoxic oedema development following a stroke. Although this model includes only three sub-models and would need to integrate more mechanisms in each of these sub-models, the characteristics and the time and spatial evolution of penumbra obtained by simulation are qualitatively and, to some extent, quantitatively consistent with those observed using medical imaging after a permanent occlusion or after an occlusion followed by a reperfusion. This article describes the origin and the work of a volunteer run nonprofit agency designed to provide low cost psychotherapy. The agency was developed by psychotherapists connected with the Seattle University graduate program guided by the vision of psychotherapy as a healing relationship and in response to a growing crisis in the mental health system. Given the increasing complexity of living in a global village, countries and regions that are parts of larger political entities frequently have considered the option of separating or seceding an ideal solution to their problems with a larger center of power. Isolation, a form of “freedom from,” has the potential of offering them free rein or “freedom to” manage their affairs for their own sake. Francophone playwrights and filmmakers have found the dialectical interplay between “freedom from” and “freedom to” fertile (...) dramatic soil for plays and films. Some of them work in both of these and other genres. These works seem to ask the same question: Is it desirable or possible to achieve both, even in ideal isolation, without suffering cultural stagnation or repeating the abuse of power on the part of the political center that led to the separation? This article explores the answers to this question given in the plays of Aimée Césaire, Anne Hébert, and Wajdi Mouawad within the greater context for this issue found in J. M. In lieu of an abstract, here is a brief excerpt of the content:preface This special issue provokes a conversation between decolonial and postcolonial feminisms by asking what they are, how they speak about each other, and how they can speak to each other. Read together, the articles engage and sometimes trouble the temporal and spatial distinctions drawn between decolonial and postcolonial approaches. Kiran Asher explores overlaps between decolonial and postcolonial thought by comparing the ideas of Gayatri Chakravorty Spivak and Silvia (...) Rivera Cusicanqui on representation. Aimee Carrillo Rowe also stages a dialogue between these approaches when interrogating her family ’s Chican@ settler history. Tiara R. Na’puti and Judy Rohrer offer an account of how recent scholarship from Hawai‘i and Guåhan (Guam) has elaborated Indigenous epistemologies in settler contexts. Two articles excavate colonialism’s relationship to science: Jennifer Hamilton, Banu Subramaniam, and Angela Willey explore how two instances of population genetic research illustrate the racialized knowledge systems that undergirded colonialism, while Sandra Harding points out how the colonization of Latin America contributed to the edifice of Western science. In a related vein, Breny Mendoza centers the material role of Abya Yala (the preferred term for Latin America) in not just Spanish colonialism but British colonial expansionism and eventually the eclipsing of China. Patricia A. Schechter reflects on her trajectory as a scholar and teacher of US women’s history and the insights she has gained through 504Preface engaging decolonial scholarship. Amy Piedalue and Susmita Rishi argue for a more expansive understanding of postcolonial feminism’s reach as they review recently published titles in the field. Although Anna Tsing and Paulla Ebron’s review of feminist scholarship about the Anthropocene does not directly mention postcolonial or decolonial approaches, it nonetheless engages relevant scholarship on the environmental impact of settler modernization and capitalism. An art essay by Hyunji Kwon introduces the largely unrecognized paintings of former comfort woman Duk-kyung Kang (1929–1997) and focuses on the potential of Kang’s work to challenge Japanese colonial hierarchies. Our featured poets in this issue are Emily Zhang, Megan Kaminski, and Raina J. León. Both postcolonial and decolonial scholars have been committed to critiquing the material and epistemic legacies of colonialism. The distinctions that are frequently drawn between the two approaches, however, have been a source of disquiet to the editors of Feminist Studies, and they prompted our journal’s call for papers in 2016. A common temporal marking that concerned us was the eclipsing of postcolonialism, which was increasingly becoming viewed as passé, and a setting up of decolonial feminism as always already better in time. Decolonial approaches sometimes depicted postcolonial feminism as being only about the past, despite postcolonial feminism’s stated commitment to studying the continuing impact of colonial processes and its complex use of the prefix “post.” Our concern was, as well, with misrepresentations of postcolonial feminist priorities. The depiction of postcolonial feminism as deconstructive, abstract, elite theory confined to the ambit of modern colonial knowledge systems overlooked the important quandaries that postcolonial feminism raised about how to represent marginalized people ethically and, indeed, how to understand the very desire to represent the marginalized—whether or not we claim belonging to them. Postcolonial feminists warned against an easy embrace of alterity, noting that the desire for positioning oneself outside colonialism could naively ignore the power of colonial discourses to frame colonialism’s Other. Another set of hopes for this special issue was to dwell on the spatial markings of decolonial and postcolonial feminisms: decolonial feminism is often associated with Indigenous scholars and those from the Americas, and postcolonial feminism with scholars from South Asia, Africa, and the Middle East. These regional emphases, although not always as tidy as sometimes depicted, have produced distinct intellectual Preface 505 priorities. We must heed decolonial feminism’s insistence on engaging with the genocidal history of settler colonialism, the current manifestations of the violent dispossession of land, and its constitution of gendered racial capitalism the world over. The book falls into four segments. In the first (Chapter 1), the particular conception of deity that has been predominant in western civilization—the theistic idea of God—is explicated and distinguished from several other notions of the divine. The second segment considers the major reasons that have been advanced in support of the belief that the theistic God exists. In chapters 2 through 4 the three major arguments for the existence of God are discussed, arguments which appeal to facts supposedly available (...) to any rational person, whether religious or not. Chapter 5 considers religious and mystical experience as a source and justification for theistic belief. And in Chapter 6 we examine the role that faith may play in the formation and justification of religious belief. We also consider the important issue of whether belief in God may be entirely rational quite apart from any evidence in its behalf. The third segment undertakes an examination of the problem of evil, which some have thought to provide rational grounds for atheism, the belief that the theistic God does not exist. A number of topics quite central to theistic religion are considered in the fourth segment of the book, chapters 8 through 11. These topics include miracles, the question of life after death, problems in relating the idea of divine foreknowledge to the belief in human freedom, and problems arising from the existence of diverse religions. Family carers of individual’s living with Huntington’s Disease (HD) manage a distinct and unique series of difficulties arising from the complex nature of HD. This paper presents the validation of the definitive measure of quality of life for this group. The Huntington’s Disease Quality of Life Battery for carers (HDQoL-C) was expanded and then administered to an international sample of 1716 partners and family carers from 13 countries. In terms of the psychometric properties of the tool, exploratory analysis of half (...) of the sample, demonstrated good internal consistency and reliability. Some items on the full version did not meet psychometric thresholds and a short version (HDQoL-Cs) was developed based on more stringent criteria. Confirmatory Factor Analysis of the model structure showed a good fit for all Factors and, indicated that the HDQoL-C and HDQoL-Cs are psychometrically robust measures of quality of life. We found that carers who lived with and looked after their spouse/partner had reduced sense of coping, hope for the future and overall quality of life. Carers with children who were at risk, carried the gene or were symptomatic also had poorer quality of life outcomes. Findings indicated the HDQoL-C and HDQoL-Cs are valid in multiple languages and across varied cultures as measures of self-reported quality of life in family carers of individual’s living with HD. These psychometrically validated tools can aid and guide the implementation of therapeutic interventions to improve life quality in this population. (shrink)

From a perspective focused on Law, but open to other fields, an evaluation of the influence of Cicero’s thought the analysis of his main works is attempted. No doubt, Cicero’s ideas have been crucial in the development of Western Culture, and two thousand years later his theories still remain alive.

There are two traditions of thinking about idealization offering almost opposite views on their functioning and epistemic status. While one tradition views idealizations as epistemic deficiencies, the other one highlights the epistemic benefits of idealization. Both of these, however, identify idealization with misrepresentation. In this article, we instead approach idealization from the artifactual perspective, comparing it to the distortion-to-reality accounts of idealization, and exemplifying it through the case of the Hodgkin and Huxley model of nerve impulse. From the artifactual perspective, (...) the epistemic benefits and deficiencies introduced by idealization frequently come in a package due to the way idealization draws together different resources in model construction. Accordingly, idealization tends to be holistic in that it is not often easily attributable to just some specific parts of the model. This article examines representations of Mermaids, a charity that supports trans young people and their families, in the British press. Using corpus-assisted critical discourse analysis, we identify and chart patterns in reporting between Mermaids’ inception as a charity in 2015, and 2022, a turbulent year for both the charity and trans people in the UK more generally. The findings show that, in the early years, there is relatively little attention to Mermaids in the press. Where they are mentioned, the charity (...) is represented as a useful source of advice and support, and their service users as happy and united. However, 2018 represents a turning point, with increasingly negative and misleading portrayals of Mermaids coinciding with a rise in public interest and funding. By 2019, media interest in the charity has surged and the impression of Mermaids as a support group for families is supplanted by the image of a powerful, dangerous and controversial organisation. We argue that the increasingly excessive, negative and polarised reporting around Mermaids is a strategy for indirectly delegitimising and attacking the lives of trans young people themselves. In a burgeoning culture war, Mermaids is used as a weapon against the very people they seek to support. (shrink)

Jeffrey Moriarty argues for a return to a robust notion of stakeholder theory involving direct procedural voting by stakeholders. He asserts that such voting offers the best possible chance of restraining firm behavior and taking into account all stakeholder interests. I argue, however, that Moriarty proceeds with an overly narrow conception of democracy, ignoring problems that arise from procedural voting. Specifically, paradoxes in voting procedures, the tyranny of the majority, and the inefficacy of representation advantage well-organized and moneyed interests. Plato's dialogues are usually understood as simple examples of philosophy in action. In this book Professor Rowe treats them rather as literary-philosophical artefacts, shaped by Plato's desire to persuade his readers to exchange their view of life and the universe for a different view which, from their present perspective, they will barely begin to comprehend. What emerges is a radically new Plato: a Socratic throughout, who even in the late dialogues is still essentially the Plato (and the Socrates) of (...) the Apology and the so-called 'Socratic' dialogues. This book aims to understand Plato both as a philosopher and as a writer, on the assumption that neither of these aspects of the dialogues can be understood without the other. The Fair Trade movement seeks to alter conventional trade relations through a system of social and environmental standards, certification, and labels designed to help shorten the social distance between consumers in the North and producers in the South. The strategy is based on working both ‘in and against’ the same global capitalist market that it hopes to alter, raising questions about if and how Fair Trade initiatives exhibit counter-hegemonic potential to transform the conventional agro-food system. This paper considers the multiple (...) levels at which Fair Trade alternatives operate to identify the different forms of social action that the movement engages with, and to clarify where the movement’s counter-hegemonic potentials are being realized. I suggest the Fair Trade movement is most successful in encouraging consumers and producers to commit acts of resistance and in supporting redistributive action that shifts resources from North to South. Up to now, however, Fair Trade alternatives appear to hold only a theoretical potential to provoke transformative change in the agro-food system. A reconceptualization of the Fair Trade model and how it is implemented could allow it to manifest more of its implicit, oppositional promise. (shrink)

Pioneering researchers claim that telepsychiatry presents the possibility of improving both the quality and quantity of patient care for populations in general as well as for those in rural and remote locations. The prevalence of, and literature on telepsychiatry has increased dramatically in the last decade, covering all aspects of research endeavors. However, little can be found on the topic of ethics in telepsychiatry. Using various clinical scenarios we may provide insight into the moral challenge in telepsychiatry—the lack of in-person (...) contact. The difficulty is to articulate what the significance of in-person contact is and further, its meaning in the therapeutic relationship between the patient and the physician. Using the personalist perspective and related philosophical approaches we may sketch an idea of the patient as person, existentially considered as a relational and bodily human being. By applying Brennan’s model for health technology assessment we may evaluate the morally troubling aspect of telepsychiatry—a lack of in-person contact—on this philosophical sketch of the person. This consideration is crucial when developing policies to guide the use of telepsychiatry in order to maintain the quality of care. (shrink)

The prospective robots in healthcare intended to be included within the conclave of the nurse-patient relationship—what I refer to as care robots—require rigorous ethical reflection to ensure their design and introduction do not impede the promotion of values and the dignity of patients at such a vulnerable and sensitive time in their lives. The ethical evaluation of care robots requires insight into the values at stake in the healthcare tradition. What’s more, given the stage of their development and lack of (...) standards provided by the International Organization for Standardization to guide their development, ethics ought to be included into the design process of such robots. The manner in which this may be accomplished, as presented here, uses the blueprint of the Value-sensitive design approach as a means for creating a framework tailored to care contexts. Using care values as the foundational values to be integrated into a technology and using the elements in care, from the care ethics perspective, as the normative criteria, the resulting approach may be referred to as care centered value-sensitive design. The framework proposed here allows for the ethical evaluation of care robots both retrospectively and prospectively. By evaluating care robots in this way, we may ultimately ask what kind of care we, as a society, want to provide in the future. (shrink)

Some commentators have condemned Kant’s moral project from a feminist perspective based on Kant’s apparently dim view of women as being innately morally deficient. Here I will argue that although his remarks concerning women are unsettling at first glance, a more detailed and closer examination shows that Kant’s view of women is actually far more complex and less unsettling than that attributed to him by various feminist critics. My argument, then, undercuts the justification for the severe feminist critique of Kant’s (...) moral project. (shrink)

Research in moral psychology has recently raised questions about the impact of context and the environment on the way the human mind works. In a 2012 call to action, Paley wrote: “If some of the conclusions arrived at by moral psychologists are true, they are directly relevant to the way nurses think about moral problems, and present serious challenges to favoured concepts in nursing ethics, such as the ethics of care, virtue, and the unity of the person” (p. 80). He (...) urges nurse ethicists and scholars to evaluate the impact these findings may have for moral theory.In this paper, I review some of Paley's (Nursing Philosophy, 13, 2012, 80) critique, focusing on the argument that theories of nursing ethics have failed to account for the role of context; both in terms of its impact on the way nurses make moral judgements and in terms of the environment's influence on the way the mind works. I then examine nursing literature on moral agency, and focus on the role of the environment and context play within existing theory. I argue that theories of moral agency have often accounted for the role of context on the way nurses make decisions; however, less attention has been paid to its impact on the mind. With this background, I use insights from the fields of moral philosophy and moral psychology to refine the conceptualization of nurse moral agency in a way that is reflective of current cognitive, philosophical and nursing practice‐based science. Opposition within the organic agriculture community to a state regulatory initiative intended to close a loophole on the prohibition of stoop labor in California agriculture illuminates critical tensions around the “labor question” underpinning California's rapidly expanding organic sector. Through an exploration of the contradictions between the political economic realities of organic agriculture, the lived realities of farm workers, and the ideological framework of “agricultural exceptionalism” espoused in the organic community, this article challenges widely held assumptions that organic agriculture embodies a (...) more socially sustainable form of production. After the global economic collapse triggered by the Great Recession, there has been an increased interest in the potential psychological implications of periods of economic decline. Recent evidence suggests that negative personal experiences linked to the economic crisis may lead to diminished generalized trust (i.e., the belief that most of the people of the society are honest and can be trusted). Adding to the growing literature on the psychological consequences of the economic crisis, we propose that the perceived personal impact (...) of the economic crisis not only would undermine generalized trust but also may lead to increased interpersonal trust (i.e., directed to specific and close people) and depersonalized in-group trust (i.e., directed to individuals who, while strangers, belong to the same group [e.g., social class]). Across three studies (N = 1379), we tested these central hypotheses and ascertained whether the perceived personal impact of the crisis would predict these types of trust (assessed using questionnaire and behavioral measures) independent of individuals’ socioeconomic status. Non-experimental data from Study 1 revealed that a higher perceived personal impact of the crisis is related to lower levels of generalized trust and higher levels of interpersonal trust. These effects were independent of participants’ socioeconomic status. Non-experimental data from Study 2 replicated the findings obtained in Study 1 and also showed a positive association between the perceived personal impact of the crisis and depersonalized in-group trust. This pattern of results emerged even after controlling for socioeconomic status, gender, age, political orientation, religiosity, and unemployment status. In Study 3, using an experimental design, we found that the salience of a possible economic downturn led to decreased generalized trust and increased interpersonal and depersonalized in-group trust—independently of socioeconomic status—compared with the control condition. These results challenge the conventional wisdom that economic crises invariably undermine trust in others.
